Instrument Hire Terms and Conditions
  1. For the purposes of these terms and conditions the parent or guardian of the pupil who is receiving the lessons or is a member of an ensemble will be referred to as the customer. The customer will be the person who signs this Instrument Hire Agreement Form.
  2. During the period of hire the instrument remains the property of Milton Keynes Council (MKC).
  3. The customer is responsible for loss or damage to the instrument during the hire period. CLMK recommends you insure the instrument.  It can usually be added to your household insurance please check with your insurers.  Alternatively, specialist companies such as Allianz can arrange insurance. 
  4. The customer will advise Community Learning MK (CLMK) – Music Faculty immediately of any loss or damage to the instrument and is liable for the cost of repairing or replacing the instrument.
  5. CLMK will provide the instrument and case. Any additional items required during the rental term such as reeds, rosin, strings, slide oil, valve oil, cork grease etc. will be the responsibility of the customer.
  6. If the customer does not return the instrument prior to the end of term the customer will continue to be invoiced for the next term’s hire fee until the instrument is returned.
  7. The customer will notify CLMK of any change in details stated on this form.
  8. Hire fees will not be refunded in compensation for missed or cancelled ensembles or music lessons.
  9. If payment is not made within 30 days of the invoice CLMK reserves the right to ask the customer to return the instrument.
  10. Should the instrument required not be available for hire, the agreement and payment will be returned to the customer within one month of the application.
  11. CLMK reserves the right to increase instrument hire fees and will give written notice of any such increase no later than one full term, prior to the term when the increase in fees is due to take effect.
  12. Concessions are available for pupils eligible for Pupil Premium or by prior agreement with the MK Music Faculty and Hub Manager for exceptional circumstances. Please complete the concessions application form available on our website and submit with this instrument request agreement.  To continue to receive reduced rates, an application for concessions MUST be re-submitted at the beginning of each new academic year in September.
  13. This agreement supersedes any prior agreement between CLMK – Music Faculty and the customer, whether written or oral and any such prior agreements are cancelled at the commencement date of this agreement.
  14. Security of the instrument: The customer shall keep the instrument in his or her sole possession for the student to use and shall not lend, sublet, sell, use as security against a loan, nor allow the instrument to be seized in satisfaction of debts or for any other legal process. The customer will indemnify CLMK against all losses, costs, claims, damage and expenses howsoever occasioned by any breach of the customer
  15. Repairs: The customer shall inform CLMK immediately should any damage occur to the instrument requiring the instrument to be repaired; the customer will then be advised accordingly. No repairs may be arranged without the authority of CLMK. In the event of any damage to the instrument deemed not to be the result of fair wear and tear by CLMK, the customer will be required to pay the full cost of the repair or replacement value of the instrument.
  16. Whilst all reasonable efforts will be made to provide a replacement instrument during repairs, this cannot be guaranteed. Any replacement given to the customer will be of a similar (but not necessarily identical) type, which will be held by the customer under these same terms and conditions. Unless CLMK agrees, the customer will not be entitled to any refund between the dates of removal and replacement or substitution.
  17. Termination: The customer shall have the right to terminate this agreement at any point by returning the instrument to CLMK. The customer is responsible for returning the instrument and any expense incurred for carriage. Please note you are responsible for the instrument until it is returned to us. Please use a recognised carrier with sufficient packaging if unable to return it in person.  You will be issued with a receipt confirming the instrument has been returned.  No refund is available.
  18. CLMK reserves the right to terminate this agreement with the customer if he or she has made any misrepresentations to us, whether or not recorded above, or if the customer moves address outside our service area, or if CLMK decides within our absolute discretion that the instrument can no longer be efficiently serviced or maintained or for some other reason can no longer hire the instrument to the customer.
  19. Complaints: Any complaints raised by the customer shall be dealt with in accordance with Milton Keynes Council’s complaints procedure.
  20. Governing Law and Jurisdiction. This agreement shall be governed by and construed in accordance with the law of England and Wales.
